Use of photo radar devices violates drivers' rights

As a past prosecutor and former college law assistant professor, I oppose the proposed use of photo radar devices for enforcement purposes. While upholding the integrity of the laws of New Jersey and its municipalities is an honorable aim, I respectfully oppose the passage of bill A-2064.

The bill violates a driver's rights because it fails to address how prosecution of the actual driver of the offending vehicle could be achieved, as the registered owner of the vehicle is often not the actual driver. The provisions of the bill also reverse the "innocent until proven guilty" doctrine that is the hallmark of the United States of America's judicial system, presupposing guilt on the part of the vehicle's registered owner.
